Terms of Service
Version 1.1 · Effective date: 26 October 2026 · Last updated: 26 October 2026
Operating entity: STITCHBYTE LLP · Product: Watch · Website: https://watch.stitchbyte.in
1. Agreement and scope
These Terms of Service (“Terms”) constitute an agreement between you (“you”, “your”, or “User”) and STITCHBYTE LLP (“Stitchbyte”, “Watch”, “we”, “us”, or “our”), the operator of Watch.
These Terms govern your access to and use of Watch, including its website, Android application, accounts, synchronized watch-party rooms, chat, voice and video communication, screen sharing, interactive games, browser integrations, and paid subscriptions.
By creating an account, affirmatively accepting these Terms, or purchasing a subscription, you agree to the provisions applicable to your use of the Service.
If you do not agree, you must not use Watch.
If you access Watch on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms operate alongside our Privacy Policy, Refund and Cancellation Policy, and any additional terms presented for specific features or transactions. Mandatory applicable law prevails over any inconsistent contractual provision.
2. Eligibility and age
2.1. You must be at least 13 years old to use Watch, subject to any higher minimum age required by applicable law or the relevant platform.
2.2. Where required by applicable law, users below the age of majority must obtain valid parental or legal-guardian consent before using the Service.
2.3. You must not misrepresent your age or bypass applicable age restrictions.
2.4. We may restrict access where there is a reasonable basis to believe that an account violates applicable age requirements.
2.5. We will implement age-related notices, consent mechanisms, and safeguards as required by applicable law. A user's acceptance of these Terms does not substitute for any separately required parental consent or other authorization.
2.6. Because Watch includes social interaction, voice and video communication, and screen sharing, we may introduce additional age restrictions or safety controls for particular features.
3. Accounts and security
3.1. You must provide accurate and current registration information and keep it reasonably up to date.
3.2. You are responsible for protecting your credentials and for activity conducted through your account, except to the extent applicable law or our own conduct makes us responsible for unauthorized activity.
3.3. You must promptly notify us of suspected account compromise.
3.4. You must not sell, rent, transfer, impersonate, or improperly share accounts or use another person's credentials without authorization.
3.5. We may take reasonable measures to verify account ownership, investigate suspected fraud, protect users, and comply with legal obligations.
4. What Watch does and does not provide
4.1. Watch is a social entertainment service designed to help users watch together, synchronize supported playback, communicate, share screens, interact, and play supported multiplayer games.
4.2. Watch may provide synchronization controls, links, embeds, browser integrations, or screen-sharing functionality, depending on the feature and device.
4.3. Unless expressly stated otherwise, Watch does not own, license, sell, or independently distribute third-party films, television programmes, music, sports broadcasts, or other entertainment content.
4.4. Watch does not grant users a license to third-party content merely by providing playback synchronization or screen-sharing functionality.
4.5. You are responsible for obtaining the subscriptions, permissions, and other rights required to access and use content through your chosen sources.
4.6. Third-party services may change their terms, restrict integrations, or discontinue functionality. We do not guarantee compatibility or uninterrupted playback.
5. Copyright and third-party services
5.1. Your use of third-party streaming services, websites, media players, and applications is subject to their applicable terms and restrictions.
5.2. You must not use Watch to facilitate unauthorized copying, redistribution, public performance, rebroadcasting, or other infringement of third-party rights.
5.3. You must not use Watch to unlawfully bypass DRM, encryption, access controls, subscription requirements, or other technical protection measures.
5.4. You must not use browser integrations or other technical methods to circumvent third-party restrictions unlawfully.
5.5. We may disable integrations, restrict access to links, or take other proportionate measures in response to credible infringement complaints, security risks, or legal requirements.
5.6. We will process valid legal notices and competent-authority directions in accordance with applicable law.
5.7. Nothing in these Terms excludes liability for our own conduct or any obligation imposed on Watch by applicable law.
6. User content and conduct
6.1. “User Content” includes chat messages, profile information, room names, invitations, reactions, and other material that you submit or share through Watch.
6.2. You retain ownership of User Content that you own.
6.3. You grant Watch a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and technically process your User Content only as reasonably necessary to provide the Service, maintain security, enforce these Terms, and comply with law.
6.4. This license does not transfer ownership to us or authorize unrelated commercial exploitation of your content.
6.5. You represent that you have the rights and permissions required to share your User Content.
6.6. You must not use Watch to:
- Harass, threaten, stalk, impersonate, defraud, or unlawfully discriminate against anyone.
- Share unlawful material, child sexual abuse material, non-consensual intimate imagery, or other prohibited content.
- Infringe intellectual-property, privacy, publicity, or confidentiality rights.
- Send spam, phishing messages, malicious links, or deceptive invitations.
- Obtain unauthorized access to accounts, rooms, APIs, databases, or infrastructure.
- Introduce malware, overload the Service, or circumvent security controls.
- Scrape or exploit the Service except as authorized by us or permitted by law.
- Manipulate payments, abuse promotions, or obtain paid functionality without authorization.
- Use bots or scripts to abuse the Service or violate third-party rights.
- Interfere with another user's safe and intended use of Watch.
6.7. We may investigate suspected violations and take proportionate action, including warnings, content restrictions, feature limitations, suspension, termination, or reporting to authorities where legally required or justified.
7. Rooms, communications, and screen sharing
7.1. Room creators and participants are responsible for their invitations, shared material, and conduct.
7.2. Private or invite-only rooms do not guarantee absolute confidentiality. Other participants may independently retain, screenshot, photograph, record, or disclose information visible or audible to them.
7.3. You must obtain any consent required by applicable law before recording or redistributing another person's communications.
7.4. Before sharing your screen, browser tab, application window, microphone, or camera, ensure that the correct information and participants are selected.
7.5. Screen sharing may expose notifications, messages, account information, or confidential material. You are responsible for reviewing what is visible before sharing.
7.6. Watch does not intentionally record voice calls, video calls, or shared-screen sessions as part of its ordinary operation.
7.7. The absence of intentional recording does not mean that Watch collects no connection metadata, diagnostics, or security logs. Relevant data processing is described in the Privacy Policy.
7.8. We do not guarantee uninterrupted calls, synchronization, or screen sharing.
8. Free and paid plans
8.1. Watch may offer a free plan (“Watch Free”) and optional paid subscriptions, including “Watch+”.
8.2. The features, price, billing period, limitations, and renewal conditions for each plan will be disclosed before purchase.
8.3. Features labelled “Soon”, “Coming Soon”, or “Beta” are not guaranteed to be available as part of a paid plan unless expressly included in the offer.
8.4. A subscription grants access to the features described for the applicable subscription period. It does not transfer ownership of Watch or its intellectual property.
8.5. We may introduce reasonable technical, security, and usage limits. We will not knowingly misrepresent the features purchased.
8.6. Where a material paid feature becomes unavailable, we will provide the notice and any cancellation, refund, or other remedy required by the applicable agreement and law.
9. Payments, subscriptions, and cancellation
9.1. Website purchases may be processed through authorized payment providers, including Razorpay or Stripe where available. Eligible purchases within the Android application may be processed through Google Play Billing.
9.2. The payment channel, price, billing frequency, applicable taxes, renewal conditions, and cancellation method will be disclosed before purchase.
9.3. Google Play purchases are subject to applicable Google Play billing, subscription, and refund policies. Website purchases are subject to the applicable checkout terms and payment-provider policies.
9.4. We do not intentionally store complete payment-card credentials or banking authentication secrets on our own systems. Payment providers may process and retain payment information under their own policies and applicable law.
9.5. Recurring payments will be processed only in accordance with the authorization you provide and applicable payment rules.
9.6. If a payment fails, we may notify you, retry payment where permitted, or restrict paid features in accordance with the disclosed terms and applicable law.
9.7. Paid subscriptions may renew automatically where this has been clearly disclosed and validly authorized.
9.8. You may cancel through the applicable Watch account controls or the relevant payment platform. Google Play subscriptions may need to be cancelled through Google Play.
9.9. Deleting the application or closing your Watch account does not necessarily cancel an externally purchased subscription.
9.10. Unless a different lawful arrangement is disclosed, cancellation stops future renewals when effective, and paid access continues until the end of the period already paid for.
9.11. We will not knowingly continue charging for a subscription after a valid cancellation has taken effect, except for amounts lawfully due under a disclosed arrangement.
9.12. Price changes will be communicated in advance where required by law or platform rules. We will not apply a price increase retroactively to a completed billing period unless a lawful arrangement expressly permits it.
10. Refunds and consumer rights
10.1. Our Refund and Cancellation Policy is available at: https://watch.stitchbyte.in/refunds
10.2. Cancellation and refund eligibility are separate matters. Cancellation stops future renewals; it does not automatically establish a right to a refund for a completed billing period.
10.3. Where permitted by law, we may decline discretionary refunds for an unused portion of a subscription after access has been provided.
10.4. Nothing in these Terms excludes a refund, replacement, cancellation right, statutory remedy, or consumer protection that cannot lawfully be excluded.
10.5. Refund requests for Google Play purchases may need to be submitted through Google Play. This does not prevent Watch from providing support or issuing refunds where permitted.
10.6. If you believe a charge is incorrect, contact us with the relevant transaction details. You may also exercise rights available through the payment provider or applicable law.
11. Privacy and data protection
11.1. Our Privacy Policy explains the collection, use, disclosure, storage, retention, and deletion of personal data: https://watch.stitchbyte.in/privacy
11.2. Depending on the features used, Watch may process account information, device and connection data, chat messages, room activity, support requests, subscription status, diagnostics, and information needed to operate communication and screen-sharing features.
11.3. We will process personal data in accordance with applicable data-protection law, the Privacy Policy, and any required notices, consents, and safeguards.
11.4. Acceptance of these Terms does not replace a separate consent or authorization required by law.
11.5. Information may be retained for legitimate operational purposes, security, fraud prevention, legal compliance, dispute resolution, and enforcement, subject to applicable retention and deletion requirements.
11.6. Users may exercise their applicable privacy rights through the procedures described in the Privacy Policy.
11.7. We will implement the age-related and children’s-data safeguards required by applicable law. The 13+ eligibility rule does not waive any legal requirement applicable to children’s personal data.
12. Moderation, complaints, and enforcement
12.1. We may investigate reports concerning unlawful content, infringement, fraud, abuse, safety risks, or violations of these Terms.
12.2. Depending on the circumstances, we may restrict or remove content, disable links or integrations, limit a room, issue a warning, suspend an account, or terminate access.
12.3. We may take urgent action without prior notice where reasonably necessary to address immediate safety risks, ongoing abuse, security threats, suspected fraud, or binding legal requirements.
12.4. Where required by applicable law, we will maintain the prescribed grievance mechanism, designate the appropriate grievance contact, acknowledge complaints, and resolve them within the applicable statutory time limits.
12.5. We will process copyright complaints and legal notices in accordance with applicable law. We may request reasonable information needed to assess a complaint.
12.6. We may preserve relevant records and disclose information to competent authorities when legally required or otherwise permitted by law.
12.7. Where reasonably practicable and legally permissible, affected users may be notified of material enforcement decisions and given an opportunity to request review.
12.8. Nothing in this section authorizes arbitrary enforcement or removes mandatory user rights.
13. Intellectual property
13.1. Except for User Content and third-party materials, Watch's software, source code, branding, designs, interfaces, graphics, and documentation are owned by or licensed to STITCHBYTE LLP.
13.2. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use Watch for its intended purposes, subject to these Terms.
13.3. You must not copy, distribute, sell, sublicense, or modify our proprietary materials except as authorized by us or permitted by applicable law.
13.4. Third-party trademarks, logos, and media remain the property of their respective owners. Their presence does not imply endorsement or affiliation.
14. Suspension, termination, and account deletion
14.1. You may stop using Watch at any time and request account deletion through the available controls or our support channel.
14.2. We may suspend or terminate access for a material breach, unlawful conduct, fraud, repeated abuse, security threats, or non-payment of amounts lawfully due.
14.3. Where practicable, we will provide notice and an opportunity to address a remediable breach. Immediate action may be taken where required by law or reasonably necessary to protect users or the Service.
14.4. Account deletion and data retention will be handled under the Privacy Policy and applicable law. Information required for legal compliance, security, or a legitimate dispute may be retained for the applicable period.
14.5. Closing your account does not automatically cancel subscriptions purchased through an external platform.
14.6. Termination does not extinguish rights, remedies, or obligations that accrued before termination.
15. Indemnification
15.1. To the extent permitted by applicable law, you are responsible for losses and reasonable legal costs arising directly from your unlawful conduct, material breach of these Terms, infringement of third-party rights, or misuse of Watch.
15.2. Any indemnity is limited to losses attributable to your conduct and remains subject to causation, applicable law, and available legal defenses.
15.3. You are not required to indemnify us for losses caused by our own negligence, wilful misconduct, or unlawful conduct to the extent such liability cannot lawfully be transferred to you.
16. Disclaimers and limitation of liability
16.1. To the maximum extent permitted by applicable law, Watch is provided on an “as available” basis. We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device or third-party service.
16.2. We are not responsible for the independent conduct, statements, or availability of third-party services, except to the extent applicable law makes us responsible for our own conduct or representations.
16.3. To the maximum extent permitted by law, we will not be liable for indirect or consequential losses, including loss of profits, revenue, business opportunity, or goodwill, where those losses are legally excludable.
16.4. Subject to the exceptions below and to the maximum extent permitted by law, our aggregate liability arising out of or relating to Watch or these Terms will not exceed the amount you paid directly to us for Watch during the twelve months immediately preceding the event giving rise to the claim.
16.5. The limitation above does not apply to liability that cannot lawfully be excluded or limited, including applicable statutory consumer remedies and other mandatory obligations.
16.6. Nothing in these Terms excludes liability for fraud, wilful misconduct, or other conduct where exclusion is prohibited by law.
16.7. Nothing in this section prevents you from exercising rights or remedies available under applicable law.
17. Events beyond reasonable control
17.1. We will not be liable for delay or failure to perform an obligation to the extent directly caused by an event beyond our reasonable control, including natural disasters, widespread telecommunications failures, governmental restrictions, or major third-party infrastructure outages.
17.2. We will use reasonable efforts to mitigate the effects and resume affected services when practicable.
17.3. This section does not remove any cancellation, refund, or other remedy required by law.
18. Changes to these Terms
18.1. We may revise these Terms to reflect changes in the Service, operations, security requirements, or applicable law.
18.2. Updated Terms will be published with a revised effective date.
18.3. Where a change materially affects contractual rights or obligations, we will provide notice and obtain renewed consent where required by law.
18.4. If you do not agree to revised Terms, you may stop using Watch and cancel a subscription in accordance with the applicable cancellation terms.
18.5. We will not apply amendments retroactively to remove an accrued right or remedy where doing so is prohibited by law.
19. Governing law and disputes
19.1. These Terms are governed by the laws of India, subject to mandatory laws applicable to the user and the Service.
19.2. We encourage users to contact us first so that we can attempt to resolve disputes promptly.
19.3. Nothing in these Terms prevents a user from approaching a competent consumer commission, court, regulator, or other authority where legally entitled to do so.
19.4. Subject to applicable law and mandatory jurisdictional rights, courts having competent jurisdiction at the location of our registered office may hear disputes arising from these Terms.
19.5. Nothing in this section excludes a jurisdiction, remedy, or procedural right that cannot lawfully be excluded.
20. General provisions
20.1. Entire agreement. These Terms and the applicable policies form the agreement governing your use of Watch.
20.2. Severability. If a provision is held invalid or unenforceable, it will be limited or severed to the extent necessary, and the remaining provisions will continue to apply where legally permissible.
20.3. No waiver. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
20.4. Assignment. You may not transfer contractual rights or obligations without our consent, except where applicable law provides otherwise. We may transfer the operation of Watch as part of a legitimate business transaction, subject to applicable law.
20.5. Electronic records. To the extent permitted by law, electronic acceptance and transaction records may be used as evidence of the relevant transaction or communication.
20.6. Mandatory rights. Nothing in these Terms excludes any right, remedy, or obligation that applicable law does not permit a party to exclude.
